RIOTX / Logical Brokerage Corp. (RIOTX) is committed to maintaining your privacy and will take the utmost care with any and all personal information shared with us. RIOTX works hard to maintain the highest standards of confidentiality and to respect the privacy of our customers. In that regard, please note that RIOTX does not share your information with third parties unless it is necessary to provide services to you, these examples include and are not limited to: Bank, Platform website, and other third party licensees and service providers. RIOTX does not sell your information. This notice is pursuant to CFTC Regulation 160. 

 

COLLECTION OF INFORMATION

RIOTX collects non-public personal information about its customers through multiple sources, this information and sources may include but not be limited to the following:

  1. Individual Customer Identity Information provided by you – defined as information from the customer, this may include and is not limited to:

    2. Physical address and past physical addresses

    3. All relevant phone numbers

    4. Personal identifying information such as DOB, gender and SSN or other Tax identification.

    5. Or any other information you choose to provide.

  2. Information about the customer from the customer’s transactions with us or our affiliates;

    1. This includes trading activity

    2. Cash transfer activity

  3. Information about your creditworthiness, credit history, and other information about you from consumer reporting agencies;

    1. Bank Account information

    2. Account and routing details

    3. Username, passwords and security questions and answers with any linked accounts

  4. Information you provide to us to verify your identity, such as a passport or received from other entities not affiliated with the Company.

  5. Business Identity Information from you and the documents you provide:

    1. Entity legal name or aliases/ DBAs

    2. Physical address and past physical addresses

    3. Entity type, industry, organizational documents

    4. EIN or other Tax Identification

    5. Other information relating to authorized signers and beneficial owners

 

This information may include your details concerning your financial condition and investment qualifications, income, employment information, and credit references.

 

INFORMATION FROM OTHER SOURCES

When you create an account either a Cryptocurrency account or futures trading account you agree to send or receive funds through our platform’s website, mobile application, or phone application services. RIOTX may collect information, including nonpublic personal information about you from non-affiliated third party service providers in order to verify your identity or the identity of your business. This is done to prevent fraud and verify your identity and the identity of your business and for your protection. Information is also collected to better provide services to you.

 

This information may include:

  • Your location

  • Phone number

  • Email addresses

  • Prior address and names

  • Information made available through a bank account you link to our services

  • Account balances and transaction details

  • Contact detail associated with linked accounts

 

INFORMATION ABOUT YOUR TRANSACTIONS

RIOTX as a platform and a service to you will see all transactions preformed on our Site(s), mobile application and third party sites and services. As you the customer use and transaction on our site and services including depositing account, investment account, or to otherwise send or receive fiat currency or cryptocurrency, this and other information is collected.

 

RIOTX collects nonpublic personal information in connection with each transaction.

This includes and is not limited to:

  • Transaction time

  • Transaction amount

  • Currency information both fiat and cryptocurrency

  • Futures trading information

  • Receipts and trade confirmations

  • Details relating to the sender or receiver of funds or trades

Your access to RIOTX its Site(s) and mobile application is primarily through our online portal and platform and is limited to your internet connection and internet connected devices. RIOTX may and does collect some information related to your digital identity.

  • Your device fingerprint, includes hardware, operating system, and version

  • Unique device identifiers and mobile network information

  • Brower type

  • Pager visited on our website and pages visited before visiting our website

RIOTX primarily uses your information to provide you with the best service possible. Our goal is to provide and deliver the products and services you request. In doing so we strive to maintain your privacy and security.

We may disclose all of the information we collect, as described above, to companies that perform services on our behalf, our affiliated entities and/or to other financial institutions with whom we have execution agreements. Furthermore, to help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens and maintains an account.  When you open an account, will ask you for your name, address, date of birth and other identifying information and we may also ask to see identifying documents such as your driver’s license and passport.

 

RIOTX reserves the right to share your information as follows.

  • If we believe your actions are inconsistent with, or your account has been opened against the language in our terms and conditions agreement, our user agreements, and our policies. This includes to protect the rights, property, and safety of RIOTX, our customers, and our third party partners.

  • Aggregated or non-identifiable information, which cannot be reasonably traced to you. For example: transaction details by state, to either promote RIOTX or for financial reporting.

  • In connection with any sale, financing the acquisition of, or merger or another entity. Including the sale of a portion of our business or revenue stream to another company.

  • At your consent or at your direction.

 

DISCLOSURES TO SERVICE PROVIDERS

RIOTX uses carefully selected firms to perform services such as preparing, printing and delivering statements and other documents relating to your account, on-line trading execution systems, protection against fraud or maintaining or developing software for us which enables us to perform the tasks required as an exchange and introducing broker.  We provide only the information they need to offer our services to you.

 

RIOTX may also be legally required to exchange certain information about its customers with specific credit reporting agencies, in response to a court order, to prevent fraud or to comply with a requirement of a government agency.

 

We do not sell information about RIOTX customers or former customers to unaffiliated third parties.

 

DISCLOSURES PERMITTED BY LAW

We may disclose all the personal information we collect as permitted or required by law.  For example, we may disclose information to law enforcement agencies or regulatory authorities (such as the CFTC, SEC, NFA, FINRA, FinCEN, or the DSRO), to respond to a subpoena or court order or judicial process, to consumer reporting agencies, to comply with a requirement of a government agency (such as pursuant to the US Patriot Act) or in connection with a proposed or actual sale, merger, or transfer of all or a portion of a business or an operating unit;

 

We may also disclose information upon consent of an investor to release such information, including authorization to disclose such information to persons acting in a fiduciary or representative capacity on behalf of the investor.

 

NO DISCLOSURES FOR OTHER PURPOSES

We will not share any personal information we collect with outside companies, except as explained above.  That is, we will not sell personal information to outside companies that may wish to market their products and services to you.  While we may offer products or services to you on behalf of such outside companies, we will not give your personal information to them.

RIOTX takes commercially reasonable measure to protect your data and information from loss, theft, misuse, and unauthorized access. RIOTX carefully implements policies specifically designed to protect the confidentiality and security of your nonpublic personal information. We use encryption and authentication tools to protect your personal information.  RIOTX limits access to your nonpublic personal information to employees that have a designated business reason to view such information. RIOTX implements specific policies and procedures that are designed to protect the security and confidentiality of this information and deter against unlawful disclosure of this information.

When your account was established you provided information pertaining to your background and your financial status.  It is important that we maintain the most current information.  If there have been any material changes to your information last provided to us please contact us immediately to update your information.

 

RECORDING TELEPHONE CONVERSATIONS

RIOTX, in complying with its obligations as an Introducing Broker registered with the National Futures Association and under the jurisdiction of the Commodity Exchange Act and the rules and regulations of the Commodity Futures Trading Commission (“CFTC”) may electronically records conversations made to and from its offices.  

 

By maintaining your account with our company, you are consenting to allowing RIOTX to record conversations between RIOTX with or without the use of an automatic tone warning device.

 

All recordings shall be kept confidential will not be disclosed to any third-party except as permitted or required by law.  In addition, by maintaining your account with our company you consent to the use of the recordings as evidence by either party in any action between us.  We may, but shall not be required, in the normal course of business, erase such recordings at specified intervals.
